Terms and Conditions

All products sold through freshweekends.com are not an offer by freshweekends.com to sell any product but an invitation to you to make an offer to buy from our suppliers.

When you purchase an experience break, please remember that, in addition to the freshweekends.com terms and conditions, you will be subject to the terms and conditions of the third party supplier who supplied your experience break.  Please contact our Customer Services who will be able to provide those terms and conditions to you. 

Your Booking - Your booking is bound by the terms and conditions of the supplier and freshweekends.com and by making a booking with us, you accept the booking terms and conditions stated by both the supplier and freshweekends.com.

Website Descriptions and Photography - We have tried hard to ensure that descriptions and illustrations used on our website are accurate, however, photographs are intended to give a general idea of the experience break described and do not form part of any contract between you and freshweekends.com.

Refunds - Refunds will not be available on your experience break.  At time of booking, as it will be suggested (and for some breaks required) that you purchase insurance, if you are unable to complete your experience break, there may be the possibility of claiming through your policy.  However this will be made clear under the terms and conditions of your insurance policy.
 
Cancellation Policy - As freshweekends.com act as an agent, supplier cancellation policies vary. You will be advised by freshweekends.com if you can rebook through the cancellation cover.  If you need to change or cancel your experience break, it is your responsibility to notify freshweekends.com in writing of such request. Some suppliers do not allow changes.  Please note that because the contract for the experience break is between you and the supplier, freshweekends.com have no discretion in deciding whether the experience break can be cancelled or modified. 

Making Hotel Bookings and Cancellations - We operate as a disclosed agent for third party suppliers (the hotels on our site). This means that the contract for the accommodation is between you and the supplier. In many cases this will mean that there are additional terms and conditions governing the contract as each supplier may have their own terms and conditions. Whilst we provide details of suppliers' policies these details are not intended to be a full list of the terms and conditions of any supplier.

When you make a booking a legally binding agreement is made when all your details have been entered and you click the "CONFIRM" button on the appropriate web page.

You undertake that the details you provide us with in making a booking are correct.

You can make cancellations either by contacting the supplier directly, or by going to the cancellation page shown at the bottom of your confirmation email. In the event that you use activehotels.com to cancel your booking we will inform the supplier of the cancellation within a reasonable time. Please be aware that the supplier may impose a cancellation charge depending on how far in advance of the booking you cancel. We do not accept liability for any cancellation charges incurred other than through failure to notify a supplier within a reasonable time of receiving your notification to cancel.

Hotel Payment - In order to make a booking you must be over 18 years old and have the legal capacity to make the transaction. You undertake that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the transaction. You accept financial responsibility for all transactions made under your name or account.

Suppliers - Experience breaks are provided by suppliers who are neither employed by nor act as agents of freshweekends.com. Experience breaks are provided by the supplier subject to the supplier’s own terms and conditions, a copy of which will be made available to you on request.  Consequently, freshweekends.com cannot accept liability for any act or omission or negligence of a supplier, nor any other liability arising out of the provision of the experience break to you. Freshweekends.com is not a provider of services.

Age Size and Health Restrictions - For safety reasons, some activities have certain size, age and health restrictions. You are required to notify freshweekends.com and/or the supplier of any relevant medical condition. Our Customer Contact Centre can advise of any restrictions at the time of booking.

If We Cancel or Change Your Booking - If we cancel your experience break, we will tell you as soon as possible and do our very best to offer a suitable alternative or try to find the best possible replacement. If this is not possible, we reserve the right to cancel your experience break at short notice and re-book or refund you. We reserve the right to reschedule your experience break due to factors beyond our control.

In Case of Problems - In case of a problem, please speak to the supplier at the time that the problem occurs so they have the opportunity to resolve any problems there and then. Any other complaints should be addressed to the customer service department at freshweekends.com, who will take up the problem with the supplier on your behalf.

Prices - We reserve the right to change prices without notice, provided we inform you before the order has been dispatched and payment has been taken. Prices on our website are inclusive of VAT.  You will be charged a 2% surcharge if you use a credit card (not if you use a debit card).

Statutory Rights - These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and freshweekends.com agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause.

Subject to Availability - Please note, some of our experience breaks are sold ‘subject to availability’ – this means that we do not confirm your order immediately but we will call our suppliers who will check to see if the experience break is available.  If it is, freshweekends.com will book it for you and confirm by e mail.  If it is not, freshweekends.com will revert to you directly.

Insurance - Travel, cancellation and personal accident insurance is recommended (in the case of some suppliers, it is required) and will be offered at time of booking. Separate terms and conditions will apply to your insurance policy as this will be offered through an independent insurance provider. You should read this policy carefully as it gives full details of what is and is not covered and the conditions of the cover.

Visas, Passports and Inoculations - Any visa, passport and inoculation requirements are your responsibility and failure to obtain the relevant documentation is not the responsibility of freshweekends.com.

Freshweekends.com does not accept liability for damage to property or consequential loss or injury of any kind, except where death or injury is caused by the negligence of freshweekends.com or its servants or agents. In no circumstances shall freshweekends.com total liability for any claim exceed the price of the product supplied.
